If you appeal a decision under section 453 and you win, the Director can still take action. The Director can refuse or cancel an aviation document, or take action against a person, if they find new facts or evidence. This can happen to the aviation document or person that the appeal was about, or to a document or approval that was given because of the appeal decision.

The Director can take these actions if they have good reasons to do so. You can appeal against the Director's decision, just like you appealed against the original decision.

The Director's actions are subject to the same appeal rights as the original decision that was appealed against.

455Further action of Director after appeal determined

  1. Even though an appeal under section 453 may have been determined in favour of the appellant, the Director may, on any sufficient grounds supported by facts or evidence discovered since the hearing of the appeal, refuse to grant, revoke, suspend, disqualify, or otherwise deal with, in accordance with the provisions of this Act, any—

  2. aviation document to which the appeal related; or
    1. person to whom the appeal related; or
      1. aviation document or approval granted or restored in compliance with the decision of the District Court on the appeal.
        1. Any action taken by the Director under subsection (1) is subject to the like right of appeal as the decision originally appealed against.
