106Applying for aviation document while disqualified
A person who, without reasonable excuse, applies for or obtains an aviation document knowing or having proper notice that they are disqualified by an order of the court from obtaining such a document commits an offence.
Any aviation document in respect of which an offence is committed under subsection (1) is of no effect.
A person who commits an offence against subsection (1) is liable on conviction,—
- in the case of an individual, to imprisonment for a term not exceeding 6 months or to a fine not exceeding $15,000, or both:
- in the case of any other person, to a fine not exceeding $50,000.
If a person is convicted of an offence under subsection (1), the court may order the person to be disqualified from holding or obtaining an aviation document for any period not exceeding 12 months that the court thinks fit.
