The Governor-General can make regulations to help with the transition to the new Civil Aviation Act 2023. You will see these regulations made on the recommendation of the Minister. The regulations can provide extra rules or replace some rules in Schedule 1 about how the Act comes into force.

The regulations can say that some parts of the Act do not apply for a while. They can also give special meanings to certain words during this time. Some old rules that are being replaced can still be used for a little while.

427Regulations providing for transitional matters

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations—

  2. providing transitional and savings provisions concerning the coming into force of this Act that may be in addition to, or in place of, the transitional and savings provisions in Schedule 1:
    1. providing that, subject to such conditions as may be specified in the regulations, during a specified transitional period,—
      1. specified provisions of this Act (including definitions) do not apply:
        1. specified terms have the meaning given to them by the regulations:
          1. specified provisions repealed or amended or revoked by this Act continue to apply:
          2. providing for any other matters necessary for facilitating or ensuring an orderly transition from the provisions of any enactments replaced by this Act to the provisions of this Act.
            1. No regulations made under this section may be made, or continue in force, later than 2 years after the date of commencement of this section.

            2. Regulations made under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
