If you are an eligible New Zealand operator and you fail to submit an emissions report to the Secretary on time, the Secretary can step in. 209Secretary may determine emissions if eligible New Zealand operator fails to submit emissions report

  1. This section applies if an eligible New Zealand operator fails to submit an emissions report to the Secretary under section 208 by the time referred to in section 208(2)(a).

  2. The Secretary may estimate the operator’s emissions for the relevant reporting period—

  3. using the information available to the Secretary; and
    1. in accordance with the regulations.
      1. The regulations apply with any necessary modifications where the calculation is made under subsection (2).
