When you read this part of the law, some words have special meanings. The word capacity means what is said in section 174. The word international carriage by air refers to flying people, bags, or goods between New Zealand and another country, or flying between two other countries if the flight is organised in New Zealand.

The word tariff refers to a statement that says what prices and conditions apply to flying with certain airlines. This statement must say which airlines it applies to, what the prices are for flying between certain places, and what conditions apply to those prices. It must also say what conditions apply to flying between those places at those prices.

194Interpretation in this subpart

  1. In this subpart, unless the context otherwise requires,—

    capacity has the meaning given to it in section 174

      international carriage by air means the carriage by air of persons, baggage, or cargo—

      1. between New Zealand and any place outside New Zealand; or
        1. where that carriage is purchased, sold, or arranged in New Zealand, between places outside New Zealand

          tariff means a statement—

          1. that is expressed to apply—
            1. to 1 or more specified airlines; or
              1. to all airlines other than 1 or more specified airlines; or
                1. to all airlines; and
                2. that specifies—
                  1. the fares, rates, and charges applicable to international carriage by air between specified points (irrespective of whether direct, indirect, or involving any stopovers) that may, at any time, be provided by the airlines to which it is expressed to apply; and
                    1. any conditions subject to which the fares, rates, and charges, or any of them, are to apply to international carriage by air between those points; and
                      1. any conditions subject to which international carriage by air between those points is to be provided on such fares, rates, and charges.
