When you read this part of the law, some words have special meanings. You need to know what these words mean to understand the law. An accredited verification body is an entity that the Secretary has approved to check emissions reports.

A flight is attributed to a New Zealand operator if it follows the rules made under the law. However, some flights are excluded, such as those for medical or search and rescue purposes. These excluded flights are not counted when looking at an operator's emissions.

An eligible unit is an emissions unit that has been approved under the regulations, which are made under section 409. A New Zealand operator is a person who has a business in New Zealand and operates flights to places outside New Zealand. The regulations also prescribe a reporting period, which is a period of time when emissions must be reported.

You are an eligible New Zealand operator if you are a New Zealand operator and your flights produced a lot of emissions in the previous year. 205Interpretation

  1. In this subpart, unless the context otherwise requires,—

    accredited verification body means an entity accredited by the Secretary to verify emissions reports under this subpartattributed flight

    1. means a flight attributed to an eligible New Zealand operator in accordance with the regulations; but
      1. does not include any flight that is an excluded flight

        eligible unit means an emissions unit approved under the regulations

          excluded flight means a flight that—

          1. is principally for medical, firefighting, humanitarian, or search and rescue purposes; or
            1. is conducted on behalf of the New Zealand Government for non-commercial purposes in the exercise of New Zealand’s functions or duties as a sovereign State

              New Zealand operator means a person who—

              1. has a registered place of business in New Zealand; and
                1. operates an air transport service offering air transport services to 1 or more places outside New Zealand as a New Zealand airline

                  regulations means regulations made under section 409

                    reporting period means a reporting period prescribed by the regulations.

                    1. A person is an eligible New Zealand operator in relation to a calendar year if the person—

                    2. is a New Zealand operator; and
                      1. in the previous calendar year produced from its attributed flights annual emissions of greater than an amount prescribed by the regulations.
                        1. A person is a new entrant if—

                        2. the person meets the criteria specified in subsection (2)(a) and (b) for the first time on or after the date on which this subpart comes into force; and
                          1. the activity in respect of which the person meets those criteria is not in whole or in part a continuation of an activity previously performed by another person.
