195: When person may apply for authorisation

You can apply to the Minister for an authorisation if you are doing, or plan to do, international flights. You must be working with other people or companies who are also doing international flights. You need to think that your agreement with them might break certain rules, such as section 27 or section 30 of the Commerce Act 1986.

You have to make your application in the way the Minister says. The Minister will tell you how to apply. Your application is also subject to section 204.

When you apply, you might be planning to work together with other companies on international flights. You might want to make a contract or arrangement with them. You need to follow the rules when you make your application.

195When person may apply for authorisation

  1. A person may apply to the Minister for an authorisation in accordance with this subpart if—

  2. the person is conducting, or intends to conduct, international carriage by air; and
    1. the person wishes to—
      1. enter into a contract or an arrangement, or arrive at an understanding, where all parties to the contract, arrangement, or understanding are, or will be, conducting international carriage by air in co-operation with each other; or
        1. give effect to a provision of a contract or an arrangement or understanding where all parties to the contract, arrangement, or understanding are, or will be, conducting international carriage by air in co-operation with each other; and
        2. the person considers that—
          1. the contract, arrangement, or understanding would, or might, contravene section 27 of the Commerce Act 1986; or
            1. the contract, arrangement, or understanding would, or might, contravene section 30 of the Commerce Act 1986 and section 31 of that Act does not apply to the contract, arrangement, or understanding.
            2. The application must be made in any form and manner required by the Minister.
