195When person may apply for authorisation
A person may apply to the Minister for an authorisation in accordance with this subpart if—
- the person is conducting, or intends to conduct, international carriage by air; and
- the person wishes to—
- enter into a contract or an arrangement, or arrive at an understanding, where all parties to the contract, arrangement, or understanding are, or will be, conducting international carriage by air in co-operation with each other; or
- give effect to a provision of a contract or an arrangement or understanding where all parties to the contract, arrangement, or understanding are, or will be, conducting international carriage by air in co-operation with each other; and
- enter into a contract or an arrangement, or arrive at an understanding, where all parties to the contract, arrangement, or understanding are, or will be, conducting international carriage by air in co-operation with each other; or
- the person considers that—
- the contract, arrangement, or understanding would, or might, contravene section 27 of the Commerce Act 1986; or
- the contract, arrangement, or understanding would, or might, contravene section 30 of the Commerce Act 1986 and section 31 of that Act does not apply to the contract, arrangement, or understanding.
- the contract, arrangement, or understanding would, or might, contravene section 27 of the Commerce Act 1986; or
The application must be made in any form and manner required by the Minister.
