460: Delegation of Director’s functions or powers to employees of CAA

The Director of the Civil Aviation Authority (CAA) can give some of their jobs or powers to CAA employees. You can think of jobs as functions and powers as the ability to make decisions. The Director can give employees jobs or powers that are in the Civil Aviation Act or other laws.

The Director must write down which jobs or powers they are giving to employees. When the Director gives jobs or powers to employees, they must follow the rules in the Act. 460Delegation of Director’s functions or powers to employees of CAA

  1. The Director may delegate to any employee of the CAA any of—

  2. the Director’s functions and powers under this or any other Act; or
    1. the functions or powers delegated to the Director under this Act.
      1. A delegation under this section must be in writing.

      2. Despite subsection (1), the Director must not delegate the power under section 98 to revoke an aviation document.

      3. Subsection (1) is subject to any other provision of this Act that provides that the Director must not delegate a particular function or power.

      4. The Director must not delegate any functions or powers delegated to the Director by the Minister without the written consent of the Minister.
