389: Exercise of powers under this subpart

The Director can let an aviation security officer or another person use a power or do a job under this part of the law. You need to know that the person the Director chooses must carry a special card that says who they are and what they can do. This card is issued by the Director and it lists the person's name, their job, and the powers they have.

If the Director gives someone permission to do a job, a constable can also do that job. The Director can give a constable the same powers as the person they chose. You can read more about what constables can do in section 331.

The rules in this section do not change what is said in section 331, you can still follow the rules in that section. This means that constables and the people the Director chooses have the same powers and must follow the same rules. 389Exercise of powers under this subpart

  1. The Director may authorise an aviation security officer or any other person to exercise a power or perform a function under this subpart.

  2. A person authorised by the Director under subsection (1) must carry evidence of authority issued by the Director that specifies—

  3. the name of, and the office or offices held by, the person; and
    1. the powers and functions that the person is authorised to exercise and perform under this subpart.
      1. A constable may exercise and perform all or any of the powers and functions that may be conferred on a person authorised by the Director under this subpart.

      2. This section does not limit section 331.
