32Functions and powers of Director

  1. The Director has and may perform or exercise—

  2. the functions, powers, and duties that may be conferred or imposed directly on the Director under this or any other Act; and
    1. the functions and powers delegated to the Director by the board of the CAA under this Act or any other Act.
      1. Without limiting subsection (1), the Director’s functions and powers include—

      2. providing leadership within the CAA in relation to those matters for which the CAA or the Director is responsible; and
        1. exercising control over entry into, activities within, and exit from the civil aviation system through aviation documents or other instruments; and
          1. monitoring and investigating the performance and competence of aviation participants; and
            1. monitoring, investigating, and enforcement in relation to matters under civil aviation legislation; and
              1. monitoring and evaluating the performance of AvSec and any person who carries out functions within the civil aviation system in a regulatory capacity; and
                1. ensuring regular reviews of the civil aviation system to promote the main and additional purposes of this Act; and
                  1. entering into arrangements with CASA for the purpose of giving effect to the ANZA mutual recognition agreements; and
                    1. issuing warnings, reports, or guidance, or making comment, about—
                      1. any matter relating to civil aviation; or
                        1. 1 or more aviation participants; or
                          1. 1 or more persons who engage in conduct in relation to civil aviation; and
                          2. co-operating with, or providing advice and assistance to, any government agency, local government agency, or aviation participant.
                            1. The Director’s independent functions are to—

                            2. issue, suspend, revoke, and impose conditions on aviation documents and medical certificates:
                              1. grant exemptions under this Act:
                                1. carry out any enforcement responsibilities conferred on the Director under this or any other Act.
                                  1. When performing a function referred to in subsection (3),—

                                  2. the Director must act independently; and
                                    1. the Minister, the board of the CAA, and the Secretary must not give directions to the Director in relation to performing that function.
