40Requirements for selling or supplying standard firearm, blank-firing gun, or airgun

  1. A person may only sell or supply a standard firearm to another person (B) if B holds a firearms licence.

  2. A person may only sell or supply a blank-firing gun to another person (B) if B holds a firearms licence.

  3. A person may only sell or supply an airgun to another person (B) if B—

  4. is aged between 16 years and 18 years and holds a firearms licence; or
    1. is of or over the age of 18 years.
      1. Subsections (1) to (3) are subject to any other provision of this Act that provides otherwise.

      2. A person commits an offence and is liable on conviction to imprisonment for a term not exceeding 3 years, or to a fine not exceeding $40,000, if the person, without reasonable excuse, contravenes subsection (1) or (2).

      3. A person commits an offence and is liable on conviction to imprisonment for a term not exceeding 2 years, or to a fine not exceeding $20,000, if the person, without reasonable excuse, contravenes subsection (3).
