333Voluntary delivery to Arms Regulator or Police of arms items or ammunition

  1. If any arms item or ammunition is delivered to an officer of the Arms Regulator or a member of the Police by a person who is not authorised to be in possession of the item or ammunition, the Police have the discretion not to prosecute in any case where—

  2. the offence is considered to be one of possession only; and
    1. there is no public interest in proceeding with the prosecution.
