248Occupier of premises or driver of vehicle deemed to be in possession of standard firearm, restricted firearm, imitation firearm, pistol, restricted weapon, airgun, restricted magazine, or explosive found in premises or vehicle

  1. This section applies to a person who is—

  2. in occupation of any land or building on which any standard firearm, restricted firearm, imitation firearm, pistol, restricted weapon, airgun, restricted magazine, or explosive is found:
    1. the driver of any vehicle in which any standard firearm, restricted firearm, imitation firearm, pistol, restricted weapon, airgun, restricted magazine, or explosive is found.
      1. For the purposes of this Act, the person is deemed to be in possession of the standard firearm, restricted firearm, imitation firearm, pistol, restricted weapon, airgun, restricted magazine, or explosive, unless the person proves that it was not their property and that it was in the possession of some other person.

      2. Subsection (2) does not exclude the liability of any other person.
