264Purchasing arms items intending to unlawfully sell or supply

  1. A person commits an offence if the person purchases or acquires, or enters into a contract or an arrangement to purchase or acquire, an arms item intending to sell or otherwise supply the arms item to another person who is not lawfully entitled to possess the arms item.

  2. A person who is not lawfully entitled to possess an arms item (A) commits an offence if A enters into a contract or an arrangement, or arrives at an understanding, with the holder of a firearms licence or business licence (B) for the purchase or acquisition of an arms item by B on behalf of A.

  3. A person who commits an offence against subsection (1) or (2) is liable on conviction to a term of imprisonment for a term not exceeding 7 years.
