250Unlawfully carrying or possessing explosive

  1. A person commits an offence if the person, without having a lawful, proper, or sufficient purpose,—

  2. carries any explosive; or
    1. possesses any explosive.
      1. A person who commits an offence against subsection (1) is liable on conviction to imprisonment for a term not exceeding 5 years or to a fine not exceeding $15,000.

      2. In any prosecution for an offence against subsection (1) in which it is proved that the defendant was carrying, or in possession of, any explosive, the burden of proving the existence of a lawful, proper, and sufficient purpose lies on the defendant.
