Building Act 2004

Building - Code compliance certificates, certificates of acceptance, and compliance schedules - Code compliance certificates

93: Time in which building consent authority must decide whether to issue code compliance certificate

You could also call this:

“The building authority has to decide quickly if your building is safe and follows the rules.”

When you want a code compliance certificate for your building work, you need to know how long it takes for the building consent authority to decide. The authority has 20 working days to make a decision after you apply for the certificate. If you and the authority agree, they can take longer than 20 days.

If you don’t apply for a certificate, the authority has 20 working days after two years from when your building consent was granted. You and the authority can agree to extend this time if needed.

The authority has to make a decision within these timeframes even if you don’t apply for a certificate. They can ask you for more information about your application during this time. If they do, the clock stops until you give them the information they need.

Remember, the time starts when you apply for the code compliance certificate, or after two years from when you got your building consent if you don’t apply. The authority will work to decide within 20 working days, but you can always agree with them to take more time if necessary.
