45A: Minor variations to building consents

When you want to use plans and specifications that have a national multiple-use approval for a building consent, you can make some changes to them. You can do this when you’re applying for the building consent or when you want to change an existing building consent.

You’re allowed to make changes in two situations:

  1. If the national multiple-use approval says you can make those changes.
  2. If the changes are small customisations that are allowed by the rules.

If you make any other changes to the plans and specifications, the national multiple-use approval won’t apply anymore. This means you can’t use it for your building consent.

Remember, if you want to change a building consent that already exists, you need to look at section 45(4) of this law. The small customisations mentioned earlier are explained in the rules found in section 402(1)(kc) of this law.

45BChanges to plans and specifications that have national multiple-use approval

  1. When applying for a building consent in reliance on plans and specifications for which a national multiple-use approval has been issued, or for an amendment to such a building consent under section 45(4), changes may be made to those plans and specifications if—

  2. the changes are permitted under the terms of the national multiple-use approval; or
    1. the changes are minor customisations permitted by regulations made under section 402(1)(kc).
      1. If any other changes are made to the plans and specifications referred to in subsection (1), the national multiple-use approval does not apply.
