258: Accreditation

If you’re a dam owner, your accreditation can be taken away by the dam owner accreditation body or the chief executive. This can happen if they think you no longer meet the required standards. But before they do this, they must give you a chance to explain your side of the story.

There’s a special rule, though. If the standards for accreditation change, and you don’t meet them just because of these changes, they can’t take away your accreditation right away. You have three months to adjust to the new standards.

259Revocation of accreditation

  1. An accreditation under section 258(1) may be revoked by—

  2. the dam owner accreditation body; or
    1. the chief executive.
      1. An accreditation may be revoked only if the dam owner accreditation body or the chief executive—

      2. is satisfied that the accredited dam owner no longer meets the prescribed criteria and standards; and
        1. has first given the accredited dam owner concerned a reasonable opportunity to be heard.
          1. Despite subsection (2)(a), the dam owner accreditation body or the chief executive must not revoke the accreditation of a dam owner if—

          2. the prescribed criteria and standards for accreditation are amended; and
            1. the accredited dam owner no longer meets those criteria and standards solely as a result of the amendments.
              1. The limit in subsection (3) applies only during the period of 3 months after the date on which the amendments come into force.
