133AM: Deadline for completing seismic work on or before 1 April 2024

If you own a building that is at risk of damage from earthquakes, you must do seismic work on it by a certain deadline. The deadline is different depending on where your building is and what type of building it is. In areas with low seismic risk, you have 35 years to complete the work.

If your building is in an area with medium seismic risk, you have 12 years and 6 months if it is a priority building, or 25 years if it is not. In areas with high seismic risk, you have 7 years and 6 months if it is a priority building, or 15 years if it is not. However, if your building is a heritage building, you might be able to get an extension on the deadline, as stated in section 133AO.

You can also check clause 2 of Schedule 1AA to see if it applies to your building, which might change your deadline. You must complete the seismic work on or before 1 April 2024 if that is your deadline. The deadline is measured from the date of the first EPB notice issued for your building.

133AMDeadline for completing seismic work on or before 1 April 2024

  1. The owner of a building or part of a building that is subject to an EPB notice must complete seismic work on the building or part on or before the deadline specified in this section if that deadline is on or before 1 April 2024.

  2. The deadline is the expiry of whichever of the following periods, as measured from the date of the first EPB notice issued for the building or the part of the building (rather than any replacement EPB notice), is applicable:

  3. in an area of low seismic risk, 35 years for any building; and
    1. in an area of medium seismic risk, 12 years and 6 months for a priority building and 25 years for any other building; and
      1. in an area of high seismic risk, 7 years and 6 months for a priority building and 15 years for any other building.
        1. However,—

        2. if clause 2 of Schedule 1AA applies to the building or the part of the building, the deadline is the deadline determined in accordance with that clause; and
          1. if the building or the part of the building is a heritage building for which an extension is granted under section 133AO, the deadline is the expiry of the period of the extension, as measured from the deadline that would apply under paragraph (a) or subsection (2) if no extension were granted.
