149Who is recognised engineer

  1. A recognised engineer is an engineer who—

  2. has no financial interest in the dam concerned; and
    1. is registered under the Chartered Professional Engineers of New Zealand Act 2002; and
      1. has—
        1. the prescribed qualifications; and
          1. the prescribed competencies.
          2. In subsection (1)(a), financial interest does not include—

          3. involvement in the construction of the dam as a fully paid engineer; or
            1. entitlement to a fee for undertaking an audit; or
              1. employment or engagement as an engineer by the owner of the dam concerned.
