91: Building consent authority that grants building consent to issue code compliance certificate

When you finish building work that needs a building consent, you need to ask for a code compliance certificate. You should do this as soon as you can after the work is done. You need to fill out a special form to ask for this certificate.

You must send your request to the building consent authority that gave you the building consent. But if section 91(2) applies, you can send it to the building consent authority that will give you the code compliance certificate.

If any licensed building practitioners did work on your building, you need to include the records of their work with your request. These records are mentioned in section 88(1).

If you used a modular component in your building work, and the building consent authority used section 19(1)(da) when they gave you the building consent, you need to include a current certificate from the manufacturer for that component.

If your building work involved making or using a modular component, and you included a manufacturer’s certificate when you asked for the building consent (as mentioned in section 45(1)(bc)), you need to include a current certificate from the manufacturer for that component with your request for a code compliance certificate.

If your building work included any energy work that needed a building consent, you also need to include any energy work certificates that relate to that work.

92Application for code compliance certificate

  1. An owner must apply to a building consent authority for a code compliance certificate after all building work to be carried out under a building consent granted to that owner is completed.

  2. The application must be made—

  3. as soon as practicable after the building work is completed; and
    1. in the prescribed form; and
      1. either—
        1. to the building consent authority that granted the building consent for the building work; or
          1. if section 91(2) applies, to the building consent authority that it is proposed will issue the code compliance certificate.
          2. If applicable, the owner must include with the application any records of work provided by licensed building practitioners under section 88(1).

          3. If—

          4. the building work included the use of a modular component; and
            1. in granting the building consent, the building consent authority relied on section 19(1)(da),—
              1. the application under subsection (1) must be accompanied by a current manufacturer’s certificate for that component.

              2. If—

              3. the building work was the manufacture of, or included the use of, a modular component; and
                1. the application for building consent included a manufacturer’s certificate under section 45(1)(bc),—
                  1. the application under subsection (1) must be accompanied by a current manufacturer’s certificate for that component.

                  3. If the building work comprises or includes energy work in respect of which a building consent has been granted, the owner must also include with the application any energy work certificate that relates to the energy work.
