253: Application for accreditation

You can lose your accreditation or have it changed by the building consent accreditation body or the chief executive. They can do this only if they think you no longer meet the required standards. But before they do, they must give you a chance to explain yourself.

If the standards for accreditation change and you don’t meet them because of these changes, you won’t lose your accreditation right away. You have 3 months to meet the new standards.

The building consent accreditation body or the chief executive can’t take away your accreditation just because the standards changed. This rule only applies for 3 months after the new standards start.

254Revocation of accreditation

  1. An accreditation under section 250 may be revoked, or the scope of accreditation may be amended, by—

  2. the building consent accreditation body; or
    1. the chief executive.
      1. An accreditation may be revoked only if the building consent accreditation body or the chief executive—

      2. is satisfied that the building consent authority no longer meets the prescribed criteria and standards for accreditation; and
        1. has first given the building consent authority concerned a reasonable opportunity to be heard.
          1. Despite subsection (2)(a), the building consent accreditation body or the chief executive must not revoke the accreditation of a building consent authority if—

          2. the prescribed criteria and standards for accreditation are amended; and
            1. the building consent authority no longer meets those criteria and standards solely as a result of the amendments.
              1. The limit in subsection (3) applies only during the period of 3 months after the date on which the amendments come into force.
