Building Act 2004

Miscellaneous provisions - Civil proceedings and defences

390: Civil proceedings may not be brought against chief executive, employees, etc

You could also call this:

"People doing their job under the Building Act 2004 can't be sued if they act in good faith."

This section is about people who work with the Building Act 2004. It applies to the chief executive and their employees and agents. It also applies to people who help the chief executive with certain tasks, like investigating building failures, and people who work for territorial authorities or regional authorities.

If you are one of these people, you cannot be sued for something you did or did not do as part of your job, as long as you acted in good faith. This means you must have been trying to do the right thing under the Building Act 2004.

You can find more information about the tasks these people do in sections like section 187, section 207F, subpart 6B of Part 2, section 133BR, section 22(1), and section 25B.
