In this part of the law, unless the context says otherwise, there are some important terms you need to know:

An ‘appeal authority’ is who you go to if you want to challenge a decision. If you’re appealing the Registrar’s decision, you go to the Board. If you’re appealing the Board’s decision, you go to the District Court.

‘Applicable minimum standards for licensing’ are the rules that say what you need to do to get a licence for a specific type of work.

The ‘Board’ is a group of people set up by the law to oversee building practitioners.

‘Building inspection work’ includes checking building plans, inspecting building work, giving out building consents, making sure buildings follow the consent, and doing tasks listed in a compliance schedule.

A ‘decision’ can be an action taken under section 318 or an order.

A ‘decision-maker’ is the person or group who made the decision you’re appealing against.

A ‘disciplinary matter’ is when someone looks into how a licensed building practitioner has behaved, or a complaint about them, or a decision about that inquiry or complaint.

‘LBP standards’ are explained in section 353 of this law.

The ‘register’ is a list of all the building practitioners that’s kept up to date as required by section 298.

The ‘Registrar’ is the person in charge of the register, appointed under section 310.

282Definitions for this Part

  1. In this Part, unless the context otherwise requires,—

    appeal authority

    1. in relation to an appeal against a decision of the Registrar under section 330(1), means the Board; and
      1. in relation to an appeal against a decision of the Board under section 330(2), means the District Court

        applicable minimum standards for licensing means the minimum standards for licensing that—

        1. apply to the licensing class in question; and
          1. are contained in the rules

            Board means the Building Practitioners Board established by section 341

              building inspection work means any of the following:

              1. the assessment and approval of building design documents:
                1. the undertaking of inspections of building work:
                  1. the issuing of building consents:
                    1. determining compliance with a building consent:
                      1. inspection, maintenance, or reporting procedures stated in a compliance schedule

                        decision includes—

                        1. any action taken under section 318; and
                          1. an order

                            decision-maker, in relation to an appeal, means the person or body that made the decision or took the action appealed against

                              disciplinary matter means an inquiry into, or complaint about, the conduct of a licensed building practitioner or a decision on that inquiry or complaint

                                LBP standards has the meaning set out in section 353

                                  register means the register of building practitioners established and maintained under section 298

                                    Registrar means the officer appointed under section 310.
