442: Meaning of approved building certifier

In sections 443 to 446 of this law, an approved building certifier is someone special. You can be an approved building certifier if you meet two important conditions:

First, just before this new law started, you needed to have a valid approval as a building certifier. This approval had to be given under section 51 of the old law.

Second, your approval must still be valid. This means it was either continued or renewed under the old law or under section 441 of the new law. It’s important that this approval hasn’t expired.

If you meet both these conditions, then you’re considered an approved building certifier for the purposes of sections 443 to 446.

442Meaning of approved building certifier

  1. In sections 443 to 446, approved building certifier means a person—

  2. who, immediately before the commencement of this section, held a current approval as a building certifier under section 51 of the former Act; and
    1. whose approval is continued or renewed, and has not expired, under the former Act or section 441.
