A disciplinable entity is someone or something that can be disciplined. This can be a building consent authority, a registered PCB (product certification body), or a registered MCMCB (modular component manufacturer certification body).

The law explains what ‘grounds for disciplinary action’ means in section 201.

The respondent is the disciplinable entity that the complaint is about or that is being investigated.

When the law talks about registered PCBs or registered MCMCBs, it also includes people who were registered but their registration is on hold, and people who were registered when the problem happened, even if they’re not registered anymore.

200Interpretation

  1. In sections 200 to 203C,—

    complaint means a complaint made under section 202

      complainant means the person who makes a complaint

        disciplinable entity means any of the following:

        1. a building consent authority:
          1. a registered PCB:
            1. a registered MCMCB

              grounds for disciplinary action has the meaning given in section 201

                respondent means,—

                1. if a complaint is made under section 202, the disciplinable entity who is the subject of the complaint; or
                  1. if an investigation is commenced under section 203A, the disciplinable entity that is the subject of the investigation.

                  2. In sections 200 to 203C, a reference to a registered PCB or registered MCMCB includes—

                  3. a person who has been registered as a product certification body or modular component manufacturer certification body but whose registration is suspended; and
                    1. a person who was, at the time of the conduct in question, a registered PCB or registered MCMCB.
