There are different rules about when you need to tell the regional authority, depending on when your dam was built. If your dam was built before the government made new rules about dams, you have three months after those rules started to tell the regional authority. If your dam was built after the new rules started, you have three months from when the dam was finished to tell the regional authority.

If you sell your classifiable or referable dam to someone else, you (as the person selling it) need to tell the regional authority about the change in ownership. You have three months from when you sell the dam to do this.

133CObligation to notify regional authority of classifiable or referable dam and change of ownership

  1. The owner of a classifiable or referable dam must notify the regional authority in whose region the dam is situated of the size and location of the dam.

  2. The owner must notify the regional authority,—

  3. in the case of a dam commissioned before the commencement of the regulations referred to in section 135(2)(a), within 3 months after the commencement of those regulations; or
    1. in the case of a dam commissioned after the commencement of the regulations referred to in section 135(2)(a), within 3 months after the dam is commissioned.
      1. If the ownership of a classifiable or referable dam that must be notified under subsection (1) changes, the transferring owner must notify the regional authority of the change of ownership within 3 months of the change.
