This schedule outlines various types of building work that do not require a building consent. The exemptions cover a wide range of structures and activities, including:

General repairs and maintenance using comparable materials, as long as they don’t involve substantial replacements of systems or structural elements.

Small detached buildings like sheds up to certain size limits.

Internal alterations that don’t affect a building’s structure or safety systems.

Some types of plumbing and drainage work done by authorized professionals.

Certain outdoor structures like retaining walls, fences, and playground equipment within specified limits.

Some work on existing buildings like replacing windows or adding insulation, with restrictions.

Removal of some building elements if it doesn’t affect the structure or safety systems.

The schedule provides specific size, height and other limits for many exemptions. It also allows territorial authorities some discretion to exempt other low-risk work.

1Building work for which building consent not required

1Exempted building work

General

1General repair, maintenance, and replacement

  1. The repair and maintenance of a building product or an assembly incorporated in or associated with a building, provided that a comparable building product or assembly is used.

  2. Replacement of a building product or an assembly incorporated in or associated with a building, provided that—

  3. a comparable building product or assembly is used; and
    1. the replacement is in the same position.
      1. However, subclauses (1) and (2) do not include the following building work:

      2. complete or substantial replacement of a specified system; or
        1. complete or substantial replacement of a building product or an assembly contributing to the building's structural behaviour or fire-safety properties; or

              2Territorial and regional authority discretionary exemptions

              1. Any building work in respect of which the territorial authority or regional authority considers that a building consent is not necessary for the purposes of this Act because the authority considers that—

              2. the completed building work is likely to comply with the building code; or
                1. if the completed building work does not comply with the building code, it is unlikely to endanger people or any building, whether on the same land or on other property.

                  3Single-storey detached buildings not exceeding 10 square metres in floor area

                  1. Building work in connection with any detached building that—

                  2. is not more than 1 storey (being a floor level of up to 1 metre above the supporting ground and a height of up to 3.5 metres above the floor level); and
                    1. does not exceed 10 square metres in floor area; and
                      1. does not contain sanitary facilities or facilities for the storage of potable water; and
                        1. does not include sleeping accommodation, unless the building is used in connection with a dwelling and does not contain any cooking facilities.
                          1. However, subclause (1) does not include building work in connection with a building that is closer than the measure of its own height to any residential building or to any legal boundary.

                          3ASingle-storey detached buildings exceeding 10, but not exceeding 30, square metres in floor area and constructed of lightweight building products

                          1. Building work in connection with any detached building that—

                          2. is not more than 1 storey (being a floor level of up to 1 metre above the supporting ground and a height of up to 3.5 metres above the floor level); and
                            1. exceeds 10 square metres in floor area, but does not exceed 30 square metres; and
                              1. is built using lightweight building products for the walls and roof, and in accordance with Acceptable Solution B1/AS1 for timber or steel buildings; and
                                1. does not contain sanitary facilities or facilities for the storage of potable water; and
                                  1. does not include sleeping accommodation, unless the building is used in connection with a dwelling and does not contain any cooking facilities; and
                                    1. if it includes sleeping accommodation, has smoke alarms installed.

                                                  4Unoccupied detached buildings

                                                  1. Building work in connection with any detached building that—

                                                  2. houses fixed plant or machinery and under normal circumstances is entered only on intermittent occasions for the routine inspection and maintenance of that plant or machinery; or
                                                    1. is a building, or is in a vicinity, that people cannot enter or do not normally enter; or
                                                      1. is used only by people engaged in building work—
                                                        1. in relation to another building; and
                                                          1. for which a building consent is required.
                                                          2. However, subclause (1) does not include building work in connection with a building that is closer than the measure of its own height to any residential building or to any legal boundary.

                                                          4ASingle-storey pole sheds and hay barns in rural zones

                                                          1. Building work in connection with a pole shed or hay barn in a rural zone if—

                                                          2. any design or construction work is carried out or supervised by a licensed building practitioner; and
                                                            1. the building—
                                                              1. is not more than 1 storey (being a floor level of up to 1 metre above the supporting ground and a height of up to 4 metres above the floor level); and
                                                                1. does not exceed 110 square metres in floor area; and
                                                                  1. is not accessible by the public; and
                                                                    1. is not used to store hazardous substances within the meaning of that term in regulation 4 of the Health and Safety at Work (Hazardous Substances) Regulations 2017; and
                                                                    2. the maximum unsupported roof span in any direction does not exceed 6 metres; and
                                                                      1. either—
                                                                        1. the design wind speeds do not exceed 44 metres per second (calculated using Verification Method B1/VM1); or
                                                                          1. the building is located in a wind zone no greater than high (as defined in Acceptable Solution B1/AS1).
                                                                          2. However, subclause (1) does not include any building work in connection with a building that is closer than the measure of its own height to any residential building, public road, railway, or legal boundary.

                                                                          5Tents, marquees, and similar lightweight structures

                                                                          1. Building work in connection with any tent or marquee, or any similar lightweight structure (for example, a stall, booth, or compartment used at fairs, exhibitions, or markets) that—

                                                                          2. does not exceed 100 square metres in floor area; and
                                                                            1. is to be, or has been, used for a period of not more than 1 month.

                                                                              6Pergolas

                                                                              1. Building work in connection with a pergola.

                                                                              7Repair or replacement of outbuilding

                                                                              1. The repair or replacement of all or part of an outbuilding if—

                                                                              2. the repair or replacement is made within the same footprint area that the outbuilding or the original outbuilding (as the case may be) occupied; and
                                                                                1. in the case of any replacement, the replacement is made with a comparable outbuilding or part of an outbuilding; and
                                                                                  1. the outbuilding is a detached building that is not more than 1 storey; and
                                                                                    1. the outbuilding is not intended to be open to, or used by, members of the public.

                                                                                      Existing buildings: additions and alterations

                                                                                      8Windows and exterior doorways in existing dwellings and outbuildings

                                                                                      1. Building work in connection with a window (including a roof window) or an exterior doorway in an existing dwelling that is not more than 2 storeys or in an existing outbuilding that is not more than 2 storeys, except,—

                                                                                      2. in the case of replacement, if the window or doorway being replaced has failed to satisfy the provisions of the building code for durability, for example, through a failure to comply with the external moisture requirements of the building code; or
                                                                                        1. if the building work modifies or affects any specified system.

                                                                                          9Alteration to existing entrance or internal doorway to facilitate access for persons with disabilities

                                                                                          1. Building work in connection with an existing entrance or internal doorway of a detached or semi-detached dwelling to improve access for persons with disabilities.

                                                                                          10Interior alterations to existing non-residential building

                                                                                          1. Building work in connection with the interior of any existing non-residential building (for example, a shop, office, library, factory, warehouse, church, or school) if the building work—

                                                                                          2. does not modify or affect the primary structure of the building; and
                                                                                            1. does not modify or affect any specified system; and
                                                                                              1. does not relate to a wall that is—
                                                                                                1. a fire separation wall (also known as a firewall); or
                                                                                                  1. made of units of a building product (such as brick, burnt clay, concrete, or stone) laid to a bond in and joined together with mortar; and
                                                                                                  2. does not include sanitary plumbing or drainlaying under the Plumbers, Gasfitters, and Drainlayers Act 2006.

                                                                                                    11Internal walls and doorways in existing building

                                                                                                    1. Building work in connection with an internal wall (including an internal doorway) in any existing building unless the wall is—

                                                                                                      1. a bracing element; or
                                                                                                        1. a fire separation wall (also known as a firewall); or

                                                                                                                  1. Building work in connection with the making of a penetration not exceeding 300 millimetres in diameter to enable the passage of pipes, cables, ducts, wires, hoses, and the like through any existing dwelling or outbuilding and any associated building work, such as weatherproofing, fireproofing, or sealing, provided that—

                                                                                                                            1. is on the ground or first-storey level of the building; and
                                                                                                                              1. does not exceed 20 square metres in size; and
                                                                                                                                1. does not overhang any area accessible by the public, including private areas with limited public access, for example, restaurants and bars.

Replacement of sanitary plumbing and drainage in or associated with a building, provided that—

                                                                                                                                                                                                                                                                  1. the replacement is in the same position.

However, subclauses (1) and (2) do not include the following building work:

Building work in connection with any plinth or similar foundation if the plinth or foundation supports plant, a tank, equipment, machinery, or any similar item.

Building work in connection with a retaining wall in a rural zone, if—

                                                                                                                                                                                                                                                                                  2. the wall retains not more than 3 metres depth of ground; and
                                                                                                                                                                                                                                                                                    1. the distance between the wall and any legal boundary or existing building is at least the height of the wall.

In subclause (1), rural zone means any zone or area (other than a rural residential area) that, in the district plan of the territorial authority in whose district the building work is to be undertaken, is described as a rural zone, rural resource area, or rural environment, or by words of similar meaning.

Building work in connection with any detached building if—

                                                                                                                                                                                                                                                                                      2. the building is a kitset or prefabricated building, and the product manufacturer or supplier has complied with subclause (3); and
                                                                                                                                                                                                                                                                                        1. the building work is carried out in accordance with the design referred to in subclause (3); and

                                                                                                                                                                                                                                                                                            1. is not more than 1 storey (being a floor level of up to 1 metre above the supporting ground and a height of up to 3.5 metres above the floor level); and

                                                                                                                                                                                                                                                                                                1. does not contain sanitary facilities or facilities for the storage of potable water; and

However, subclause (1) does not include building work in connection with a building that is closer than the measure of its own height to any residential building or to any legal boundary.

The product manufacturer or supplier (as defined in section 14G) must have had the design of the building carried out or reviewed by a chartered professional engineer.
