272A: Registration of product certificates

The chief executive can also suspend a product certificate’s registration for a set time if they think:

  2. The owner of the building product or method hasn’t followed these rules.

When a product certificate’s registration is suspended, the chief executive must do two things:

  1. Tell the responsible PCB and the owner of the building product or method in writing. They need to explain why it’s suspended and what this means according to section 272D(1)(b).

  2. Update the register to show the suspension.

272BSuspension of registration of product certificate

  1. The registration of a product certificate is automatically suspended if the certificate is suspended under section 271.

  2. The chief executive may suspend the registration of a product certificate for a specified period if satisfied that—

  3. the responsible PCB has failed to comply with any product certification scheme rules; or
    1. the proprietor of the building product or building method has failed to comply with any product certification scheme rules.
      1. If the registration of a product certificate is suspended under subsection (1) or (2), the chief executive must—

      2. notify each of the following in writing of the suspension (including the reasons for it and the effect of section 272D(1)(b) (if applicable)):
        1. the responsible PCB:
          1. the proprietor of the building product or building method; and
          2. update the register accordingly.
