294: Cancellation of licensing

The Registrar has to suspend your licensing and write it down in the register if you don’t meet the minimum standards for licensing. This is explained in section 293(1).

If you’re in trouble and there’s a disciplinary process happening, the Registrar can suspend your licensing to protect the public. They will do this until an order is made under section 318 or until the disciplinary process is finished. The Registrar will also record this suspension in the register.

The Board must suspend your licensing and tell the Registrar to record it in the register in two situations. The first is when there’s a disciplinary penalty under section 318. The second is when you haven’t paid fines or costs as explained in section 319.

295Mandatory licensing suspension

  1. The Registrar must suspend a person's licensing and record the suspension in the register in accordance with section 293(1) (consequences of failure to meet applicable minimum standards for licensing).

  2. The Registrar must, in the case of a person who is the subject of disciplinary proceedings under this subpart,—

  3. suspend the person's licensing until an order is made under section 318 or until those disciplinary proceedings are otherwise finished if, in the opinion of the Registrar, suspension of the person's licensing is necessary for the purpose of protecting the public; and
    1. record that suspension in the register.
      1. The Board must suspend a person's licensing and direct the Registrar to record the suspension in the register in accordance with—

      2. section 318 (disciplinary penalties); or
        1. section 319 (non-payment of fines or costs).
