Building Act 2004

Building - Building work—Project information memoranda and building consents - Building levy

59: Liability to pay levy: territorial authority

You could also call this:

"Councils must pay a levy when they approve a building plan"

When a territorial authority grants a building consent, they become liable to pay a levy to the chief executive. This levy is the one payable under section 53 for the building work related to the consent. You need to pay the total amount of the levy by the 20th day of the month after the month the building consent was granted.

The territorial authority must send a certificate with each levy payment, saying the payment is correct. This certificate must state that the payment is correct according to the authority's financial records and to the best of the person's knowledge and belief.

The levy payment and certificate are important for the territorial authority to do when granting a building consent.
